End User License Agreement (EULA) for AudioCat Platform
1. Introduction
This End User License Agreement (“EULA”) is a legal agreement between you (“User”) and AudioCat OÜ (“Company”), governing your use of the AudioCat Platform (“Application”). By downloading, installing, or using the Application, you agree to be bound by the terms of this EULA.
2. License Grant
The Company grants you a non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial purposes in accordance with this EULA.
3. Restrictions
You may not:
- Modify, reverse engineer, decompile, or disassemble the Application.
- Distribute, sublicense, rent, lease, or lend the Application to any third party.
- Use the Application for any unlawful purpose or in violation of any applicable laws.
4. Intellectual Property Rights
The Company retains all rights, title, and interest in and to the Application, including all intellectual property rights. This EULA does not transfer any ownership rights to you.
5. In-App Purchases
The Application offers in-app purchases, including auto-renewable subscriptions and consumable subscriptions.
5.1 Auto-Renewable Subscriptions
The AudioCat subscription is required to play content on the Application. Auto-renewable subscriptions will be charged to your Apple ID account and will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage your subscription and turn off auto-renewal by going to your Account Settings after purchase.
5.2 Consumable Subscriptions
Consumable subscriptions are one-time purchases that provide access to specific content or features within the Application. These are non-renewable and must be purchased again once consumed.
6. Refund Policy
Requests for refunds must be submitted through the Apple App Store according to Apple’s refund policies. Refunds will be considered on a case-by-case basis and are subject to review by both Apple and the Company.
7. User Responsibilities
Users are responsible for maintaining the security of their account and payment information. Unauthorized use of the user’s account will be the responsibility of the user. Violations of this clause may result in termination of the user’s access to the Application and potential legal action.
8. Data Security
All user data is saved securely in compliance with industry standards. The Company employs advanced security measures to protect user data from unauthorized access, alteration, disclosure, or destruction.
9. Safety
The use of the Application while driving or in areas with heavy traffic or other hazardous environments is not advised. Users should exercise caution and prioritize safety when using the Application. The Company is not liable for any injuries or damages resulting from the improper use of the Application in such situations.
10. Term and Termination
This EULA is effective until terminated by either party. You may terminate this EULA at any time by uninstalling the Application. The Company may terminate this EULA if you violate any terms of this agreement. Upon termination, you must cease all use of the Application and delete all copies from your devices.
11. Disclaimers and Limitation of Liability
The Application is provided “as is” without warranties of any kind, either express or implied. The Company does not warrant that the Application will be uninterrupted or error-free. In no event shall the Company be liable for any damages arising from the use or inability to use the Application.
12. Governing Law
This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is headquartered, without regard to its conflict of law principles.
