Detailed Terms and Conditions for AudioCat Application
1. Introduction
Welcome to AudioCat! These Terms and Conditions (“Terms”) govern your access to and use of the AudioCat application (“Application”) provided by AudioCat OÜ, a company registered in Estonia under registry code 16563449, located in Tartu, Estonia (“Company”, “we”, “us”, or “our”). By accessing or using the Application, you agree to be bound by these Terms.
2. Application Use
- License Grant: We grant you a limited, non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial purposes as stipulated by these Terms.
- Restrictions: You may not modify, distribute, sell, or lease any part of our Application; nor may you reverse engineer or attempt to extract the source code of the software, unless laws prohibit these restrictions.
3. Account Registration
You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or other breach of security.
4. Purchases and Subscriptions
- In-App Purchases: The Application offers consumables and subscriptions which you can purchase. All transactions are processed by the platform from which the Application was downloaded (e.g., Google Play, Apple App Store).
- Subscription Management: Subscriptions are billed in advance on a periodic basis and are non-refundable. It is your responsibility to manage and cancel subscriptions via the app store.
5. Prohibited Conduct
You agree not to use the Application in any way that:
- Interferes with its normal operation or with any other user’s use and enjoyment of the Application.
- Promotes illegal activities or contributes to the creation of software that is illegal.
- Is intended to harm, or a reasonable person would understand would likely result in harm, to the user or others.
6. Intellectual Property Rights
The content, arrangement, and layout of the Application, including but not limited to, the text, images, graphics, logos, compilations, and other material are owned by AudioCat OÜ and are protected by copyright, patent, and trademark laws.
7. Safe Use Guidelines
- Driving and Walking: You must not use the Application in any way that distracts you while driving, walking, or otherwise being engaged in any activity that requires your full attention to safety.
- Volume Levels: Use the Application at safe volume levels to avoid hearing impairment.
8. Limitation of Liability
- General: To the fullest extent permitted by applicable law, AudioCat OÜ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
- Service Issues: We are not liable for any problems or service interruptions caused by third-party services or networks. This limitation of liability applies even if AudioCat OÜ has been advised of the possibility of such damages.
9. Indemnity
You agree to indemnify and hold harmless AudioCat OÜ and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Application or your violation of these Terms.
10. Termination and Suspension
We reserve the right to suspend or terminate your access to the Application if you are found to be in breach of these Terms.
11. Modifications to Terms
We may revise these Terms from time to time. The most current version will always be posted on our Application. By continuing to access or use the Application after revisions become effective, you agree to be bound by the revised Terms.
12. Governing Law
These Terms shall be governed by the laws of Estonia without regard to its conflict of laws rules. You agree to submit to the exclusive jurisdiction of the courts located in Estonia for any disputes arising out of or related to these Terms or the Application.

Acknowledgment
By using our Application, you acknowledge that you have read these Terms, understood them, and agree to be bound by them. These Terms constitute the entire agreement between you and AudioCat OÜ regarding the Application, and supersede and replace any prior agreements we might have between us regarding the Application.
